If you market into Germany, the TTDSG (and its successor naming) is what your cookie banner and tracking setup must satisfy. It sets a high bar for what counts as real consent.

A compliant setup under these rules sets only strictly necessary technologies by default, obtains genuine, informed, freely given consent before anything else, and makes declining as easy as accepting.
In the European market
This is the German implementation specifically; other EU countries have their own versions of the same EU rules. The principle is consistent, the enforcement detail is national.
